Rakyat Builder Term of Use
1. About the Hub and these Terms
1.1 The Rakyat Builders Hub (“RBH” or “Hub”) is a community and project-discovery platform within the Rakyat Digital ecosystem. It enables builders to create profiles, showcase projects, connect with other builders and discover relevant events.
1.2 The Hub is operated by MyDIGITAL Corporation [Company No. 202101029561 (1429861-M)] (“MyDIGITAL”, “we”, “us” or “our”), under the purview of the Ministry of Digital Malaysia. These Terms form a binding agreement between you and MyDIGITAL.
1.3 In these Terms:
“you” means a person accessing or using the Hub;
“builder” means a user who has completed the designated RBH onboarding process to access builder features; and
“User Content” means information or material you submit or make available through the Hub, including profile information, project materials, repository links, event submissions, connection request notes and messages.
1.4 These Terms supplement the Rakyat Digital Terms of Service at https://rakyatdigital.gov.my/en/terms (“RD Terms”). For Hub activities, these Terms prevail to the extent of any inconsistency. The RD Terms otherwise continue to apply to your use of Rakyat Digital.
1.5 You must expressly accept these Terms when completing RBH onboarding. Signing in to Rakyat Digital does not, by itself, complete onboarding or constitute acceptance of these Terms. Visitors must comply with the applicable access, content-use and conduct rules when using the Hub. If you do not agree, do not use the relevant services.
1.6 Our handling of personal data is explained in the Rakyat Digital Privacy Notice and the RBH Supplemental Privacy Notice (“Privacy Notices”). Acceptance of these Terms does not replace any separate consent required by law.
2. Access and builder onboarding
2.1 The Hub uses your existing Rakyat Digital sign-in arrangement through My Digital ID single sign-on. You do not need separate RBH login credentials. However, access to builder features requires completion of the designated onboarding process, including providing the additional information identified as mandatory.
2.2 Provide accurate, current and complete information during onboarding and keep your profile updated. Do not impersonate another person or misrepresent your skills, experience, affiliations, role or project ownership. If submitting information for an organisation or project team, obtain the necessary authority and accurately describe your role.
2.3 We may request clarification or supporting information reasonably necessary to assess eligibility, authenticity, security or compliance. We may defer or decline onboarding, or restrict builder access, on reasonable grounds relating to those matters.
2.4 Authentication through My Digital ID does not, by itself, verify a builder’s skills, affiliations, project ownership or other claims.
2.5 Protect the credentials and authentication methods used to access your account. Do not allow another person to use your builder access or use another person’s identity to complete onboarding. You are responsible for activities you authorise and for taking reasonable steps to prevent misuse. Notify us promptly of suspected unauthorised access affecting the Hub.
3. Your profile and visibility
3.1 You may maintain a public or private builder profile using the available settings. Review the information and visibility settings before saving or publishing. The RBH Supplemental Privacy Notice explains what other users, visitors and administrators can see.
3.2 Public information may be accessible to people without an account and may be indexed by search engines, copied or shared by others. Do not treat information submitted for public display as confidential.
3.3 A private profile limits visibility to other users. It does not prevent authorised administrative access or the internal processing described in the Privacy Notices. Connected builders may still see the limited profile information identified in the RBH Supplemental Privacy Notice.
3.4 Do not include identity documents, private contact details, passwords, access keys, confidential information or unauthorised personal data in public profiles or project submissions. Any location you provide should identify a town or general area rather than your residential address.
3.5 You may update your profile, change its visibility or request removal of content using the available controls or by contacting us. Changes on the Hub cannot ensure removal of copies already held by others or external services.
4. Submitting and showcasing projects
4.1 You remain responsible for your projects and associated materials. Accurately describe their purpose, development stage, contributors, dependencies and material limitations. Distinguish concepts, prototypes and demonstrations from production-ready services.
4.2 Do not fabricate performance results, users, awards, credentials or testimonials. Identify material AI-generated or AI-assisted elements where necessary to avoid misleading users.
4.3 Before submitting content, ensure that you have the rights and permissions needed for publication and the permissions granted under section 5. Respect intellectual property, confidentiality, privacy and contractual restrictions, including those relating to employers, clients and project teams.
4.4 Comply with applicable open-source and third-party licences, including attribution and notice requirements. Crediting an owner does not, by itself, grant permission to use their material.
4.5 We may review submissions before publication and review published projects subsequently for compliance, relevance and suitability. We may request clarification or corrections, decline publication, restrict visibility or remove content. Submission does not guarantee publication, featured placement or continued availability.
4.6 Our review is for platform administration. It is not an independent technical audit, security assessment, legal clearance or verification of ownership, accuracy, performance or fitness for use. You remain responsible for your content notwithstanding review or publication.
4.7 Before downloading, deploying, contributing to or relying on a project, assess it independently. A showcase does not establish that a project is secure, lawful, non-infringing or suitable for your intended purpose. Obtain appropriate checks, permissions and safeguards before using a project in a regulated or safety-critical setting.
5. Ownership and permission to use content
5.1 You and the relevant rights holders retain ownership of User Content. Submitting or showcasing a project does not transfer its intellectual property to MyDIGITAL, the Ministry of Digital or other users.
5.2 You grant MyDIGITAL a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, transmit, display and make available your User Content only to the extent reasonably necessary to operate, secure and administer the Hub and provide the features you use. Visibility and access remain subject to your applicable settings and the Privacy Notices.
5.3 We may allow service providers acting on our behalf to exercise those rights solely for their assigned functions and subject to appropriate obligations. This does not permit public disclosure of private messages, request notes or other non-public content contrary to the Privacy Notices.
5.4 For content you choose to make public, you also permit us to feature its published project title, builder username, description, images and reasonable excerpts in official communications promoting the Hub and its showcased projects, with attribution where reasonably practicable.
5.5 These permissions do not authorise us to sell your project, commercialise your code or imply your endorsement of an unrelated product. Material alterations or uses outside this scope require separate permission, including any consent required for personal data.
5.6 If content ceases to be publicly available through the Hub, we will stop new public display and promotional use, subject to a reasonable implementation period. Existing printed or archived communications need not be recalled. Retention for backups, security, legal compliance or disputes remains subject to the relevant purpose, the Privacy Notices and applicable law.
5.7 These Terms do not give other users a general right to copy, modify or commercially exploit your project. Those rights must arise from a separate licence or the rights holder’s permission. Linking to GitHub does not make a project open source or replace its repository licence.
5.8 MyDIGITAL and its licensors retain rights in the Hub’s software, design, branding and platform materials, excluding User Content and materials governed by separate licences. Do not reproduce or commercially exploit those assets without permission or another lawful basis.
6. Community conduct
6.1 Use the Hub lawfully and treat others respectfully. You shall not:
- publish unlawful, fraudulent, defamatory, threatening, discriminatory, sexually exploitative or otherwise abusive material;
- harass, stalk, intimidate or expose another person’s private information;
- infringe intellectual property, confidentiality, privacy or other rights;
- misrepresent your identity, authorship, affiliations or authority;
- conduct scams, phishing, deceptive recruitment, unlawful fundraising, unsolicited bulk messaging or unauthorised advertising;
- upload malicious code, deliberately harmful files or concealed tracking tools;
- bypass authentication, permissions or moderation, exploit vulnerabilities or interfere with service availability;
- scrape or harvest user information, manipulate visibility or engagement, or impose unreasonable loads on the Hub;
- transfer builder access, evade restrictions or misuse reporting processes; or
- suggest government or MyDIGITAL approval, sponsorship or affiliation without authorisation.
6.2 These rules also apply to material you control that is accessible through links you submit. Do not use external links to circumvent the Hub’s rules.
6.3 Report suspected Hub vulnerabilities privately to us. Do not conduct security testing without prior written authorisation, exploit vulnerabilities or expose other users’ information.
6.4 These restrictions do not remove rights expressly granted under an applicable open-source licence or mandatory law.
7. Connections messages and collaboration
7.1 Use connection requests and messaging for purposes consistent with the Hub. A connection does not create a partnership, employment relationship or obligation to collaborate. The conduct rules in section 6 apply to request notes and messages.
7.2 You are responsible for the information you send. Assess the recipient and purpose before sharing sensitive material. The messaging feature does not itself establish a confidentiality agreement between users.
7.3 Messages are not visible to other builders outside the relevant conversation. However, they are stored without end-to-end encryption. Technical access by personnel operating the service and review of reported content is governed by the RBH Supplemental Privacy Notice.
7.4 For complaint review, authorised reviewers may inspect a reported message and up to ten preceding messages for context, or the reported connection request note. Administrative access to reports is logged, as described in the RBH Supplemental Privacy Notice.
7.5 Removing a connection or blocking a builder stops new messages between the affected accounts but does not delete messages already sent. If suspension prevents you from using these controls, contact us for assistance with unwanted contact or safety concerns.
7.6 You decide whether to collaborate with, contribute to or transact with another user. Independently assess their identity, authority, suitability and project rights. Agree separately on ownership, licences, confidentiality, deliverables, payment and responsibilities before collaborating.
7.7 MyDIGITAL does not become a party to those arrangements merely because users discover or contact each other through the Hub. We may address platform-related complaints but are not obliged to mediate or determine private commercial or intellectual property disputes.
8. Events
8.1 The events tab may list events organised by MyDIGITAL or independent organisers. Follow the registration instructions and participation terms applicable to each event.
8.2 Selecting “Join”, expressing interest or recording participation on the Hub does not necessarily complete registration with the organiser, reserve a place or guarantee admission.
8.3 For independent events, the organiser is responsible for event information, delivery, admission, safety, fees, cancellations and refunds under its applicable terms. MyDIGITAL does not assume those obligations merely by listing or promoting the event. Where MyDIGITAL organises or co-organises an event, its responsibilities follow the applicable event arrangements and law.
8.4 Check event details before making travel or other commitments. Events may change or be cancelled. You are responsible for your own costs unless the applicable event terms provide otherwise. This does not remove any refund or remedy available under law or an express commitment by the responsible organiser.
8.5 Comply with event and venue rules and behave safely and respectfully. Photography, recording and attendee data arrangements must be addressed in the relevant event notices. Hub onboarding alone does not authorise unrestricted event publicity.
8.6 If submitting an event for listing, obtain the organiser’s authority, provide accurate information and promptly notify us of material changes or cancellation. Approved listings may publicly display the submitted organiser name and contact email. Only submit details you are authorised to publish. Submission does not guarantee listing.
9. GitHub connections
9.1 Connecting GitHub is optional. You sign in and authorise the connection through GitHub. You must control the account and have authority to make the connection. We will not ask for your GitHub password through a Hub form.
9.2 The integration identifies your GitHub login and reads public information for the stated Hub functions, including public repository details and publicly available contribution statistics. It does not give the Hub access to your private code.
9.3 Connecting GitHub does not transfer ownership, authorise MyDIGITAL to change your code or make a repository open source. Repository licences, third-party rights and GitHub’s own terms continue to apply.
9.4 GitHub information may appear according to your profile visibility settings and the Privacy Notices. Public availability does not establish that a project is accurate, secure, lawful or owned entirely by the account holder. Contribution statistics do not necessarily reflect all of a builder’s work or experience.
9.5 You may disconnect GitHub using the available controls and revoke authorisation through GitHub. Disconnection stops further retrieval through that connection once completed. It does not close GitHub or automatically remove descriptions, links or other content you separately submitted to the Hub.
9.6 We may disable an integration for security, legal, technical or operational reasons. We do not guarantee continuous synchronisation or the accuracy, completeness or continuing availability of external information.
10. Review recognition and endorsement
10.1 A profile, listing, connection, badge, level, contribution count or featured project does not by itself constitute endorsement, accreditation or approval by MyDIGITAL, the Ministry of Digital, the Government of Malaysia or a partner.
10.2 A Verified mark signifies only the verification process expressly described for that mark. It does not certify every statement made by a builder or the ownership, security, quality or suitability of their work.
10.3 The Hub does not itself appoint government suppliers, award funding, procure services or guarantee employment, investment, collaboration or commercial success. Any such arrangement requires a separate agreement or formal approval from the relevant party.
11. Reports and moderation
11.1 Report suspected unlawful content, infringement, impersonation, scams, harassment or other misuse to support@rakyatdigital.gov.my. Include the relevant profile, content or URL, a description of the concern, supporting evidence and your contact details. For rights complaints, identify the right claimed and your authority to act.
11.2 We may investigate suspected breaches, request information, withhold or remove content, limit features, suspend or terminate builder access and block access where reasonably necessary to address:
breaches of these Terms;
harmful or misleading conduct;
security incidents or suspected unauthorised activity;
rights complaints or legal requirements; or
material operational risks.
11.3 We may act without advance notice where delay could cause harm, compromise an investigation or contravene law. Where reasonably practicable and lawful, we will explain the general reason for material enforcement action and provide an opportunity to clarify or correct the issue.
11.4 You may request a review by contacting us and identifying the action, affected content or profile, and your reasons. Restrictions may remain during review. We are not required to restore unlawful or non-compliant content.
11.5 We do not undertake to monitor every interaction or identify every issue. We may act on content or access without determining the underlying legal rights between users. A report does not guarantee removal or resolution of a private dispute.
11.6 Record preservation, access to non-public information and lawful disclosures are governed by the Privacy Notices and applicable law. We may refer suspected offences to the relevant authorities.
12. Personal data and communications
12.1 Read the Rakyat Digital Privacy Notice at https://rakyatdigital.gov.my/en/privacy together with the RBH Supplemental Privacy Notice before completing onboarding or using relevant features.
12.2 The supplemental notice explains additional builder information, public and private profiles, exchanges with other RD systems, administrator access, messaging, events, integrations, retention and your choices.
12.3 We may send necessary account, security, moderation, connection, messaging and event notifications relevant to your use of the Hub. Hub onboarding does not authorise unrelated marketing or unrestricted publicity.
12.4 Use the available controls or contact us for profile changes, privacy concerns, consent withdrawal or deletion requests. The effect on particular features and any continuing retention are governed by the Privacy Notices and applicable law.
13. Availability and changes to the Hub
13.1 The Hub is provided on an “as-is” and “as-available” basis. Subject to applicable law and our express commitments, we do not guarantee uninterrupted access, error-free operation, compatibility with every device or external service, or the accuracy and security of third-party content.
13.2 Access may depend on My Digital ID and other independent services. Their interruptions or changes may affect Hub functions.
13.3 Keep independent copies of your projects and materials. The Hub is not your sole backup or source-code storage service.
13.4 We may maintain, modify, restrict or discontinue features or the Hub for legal, security, technical or operational reasons. Where reasonably practicable, we will give advance notice of material discontinuation and a reasonable opportunity to retrieve content available through the Hub. Urgent action may be taken without advance notice.
13.5 We do not guarantee indefinite hosting, discoverability, promotional placement or continued availability of a particular feature.
14. Leaving the Hub
14.1 You may stop using the Hub and request deactivation of your builder profile and access to builder features through the available controls or support@rakyatdigital.gov.my.
14.2 Deactivation does not, by itself, close your Rakyat Digital or My Digital ID account, close GitHub or cancel an independent event registration. Separate actions affecting those services follow their applicable procedures.
14.3 We may suspend or terminate builder access under section 12 without necessarily suspending unrelated RD services. Any wider RD action is governed by the applicable RD arrangements.
14.4 On deactivation or termination, your right to use builder-only features ends. We may remove your profile and submissions from public display, subject to reasonable processing periods. Personal data deletion and retention, including the treatment of messages and reports, follow the Privacy Notices and applicable law.
14.5 Accrued claims and provisions intended to continue remain effective to the extent relevant, including ownership, limited continuing content permissions, liability, responsibility for claims and dispute provisions.
15. Liability and responsibility for claims
15.1 Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or statutory right that cannot lawfully be excluded or limited. The provisions below apply only to the extent permitted by law and are subject to this clause.
15.2 MyDIGITAL is not liable for indirect or consequential loss, or loss of profits, revenue, business opportunities, anticipated savings or goodwill arising from use of or inability to use the Hub.
15.3 MyDIGITAL is not responsible for an independent builder’s project, another user’s conduct or an independent organiser’s or service provider’s acts solely because they are accessible through the Hub. This does not exclude liability arising from MyDIGITAL’s own actionable acts or omissions.
15.4 You shall reimburse MyDIGITAL for reasonable losses, liabilities and external legal costs arising from a third-party claim to the extent caused by your unlawful conduct, infringement of third-party rights in your User Content, or deliberate or negligent material breach of these Terms.
16. Changes to these Terms
16.1 We may revise these Terms to reflect changes to the Hub, law, security requirements or operations. We will publish the updated version and effective date.
16.2 If you do not agree to a change, stop using the affected features and request deactivation before it takes effect. Continued use after the effective date constitutes acceptance to the extent permitted by law. Where express acceptance or separate consent is required, we will obtain it.
17. General provisions and contact
17.1 These Terms are exclusively governed by Malaysian law. The Malaysian courts shall have exclusive jurisdiction over disputes arising from these Terms or the Hub. Contacting us to seek resolution does not prevent either party from pursuing available legal remedies.
17.2 These Terms do not create an employment, agency, partnership or joint venture relationship between MyDIGITAL and a user, or between users.
17.3 If a provision is unlawful or unenforceable, it applies only to the extent lawful and enforceable, and the remaining provisions continue in effect. A delay in enforcing a right is not a waiver.
17.4 If these Terms are published in English and Bahasa Melayu, the English version prevails in the event of inconsistency, to the extent permitted by applicable law.
